Terms and conditions

These terms govern the use of Tamobila, a software platform for car-rental agencies operated from Agadir, Morocco ("Tamobila", "we"). By creating an account or using the service, you ("the operator", "you") accept them. If you use Tamobila on behalf of a company, you confirm you are authorised to bind it.

1. The service

Tamobila provides fleet, rental, customer, and booking management for car-rental agencies, including hosted booking microsites, messaging channels, document scanning, telemetry integrations, and invoicing tools. The service is provided as-is, on a subscription basis, and evolves continuously — we may add, change, or retire features, and will give reasonable notice when a change materially reduces functionality you pay for.

2. Accounts and workspaces

You are responsible for the accuracy of your account information, for the actions of the members you invite into your workspace, and for keeping credentials confidential. You must be legally capable of contracting and must operate a lawful vehicle-rental activity.

3. Your content and your customers' data

Everything you put into Tamobila — fleet records, customer files, contracts, photos, messages — remains yours. You grant us only the licence needed to host and process it to provide the service. For your customers' personal data, you are the data controller and Tamobila is your processor, as described in our Privacy policy. You warrant that you collect and use your customers' data lawfully, including identity documents and driving licences.

4. Acceptable use

You agree not to: use the service for unlawful activity; upload malicious code; attempt to access other organizations' data; resell the service without our agreement; use vehicle telemetry to track individuals outside a legitimate rental relationship; or send spam through connected messaging channels. We may suspend access that endangers the platform or other tenants, with notice where practicable.

5. Microsites and custom domains

We host a booking microsite for your agency under a tamobi.la subdomain, or under a custom domain you control. You are responsible for the content you publish on it (including your own legal pages, pricing, and photos) and for honouring the bookings it produces. We may take down microsite content that is unlawful or violates these terms.

6. Plans, billing, and metered usage

Subscriptions are billed per the plan you select (per-vehicle pricing, flat fees, and/or a percentage of processed revenue, as described on the pricing page at the time of subscription). Certain features (e.g. AI usage beyond included credit, per-device add-ons) are metered and billed in arrears. Prices may change with at least 30 days' notice, applying from your next billing period. Invoices are payable on receipt; persistent non-payment may lead to suspension after notice. Taxes are your responsibility where applicable.

7. Cancellation and termination

You may cancel at any time; the service stays active until the end of the paid period, and no partial refunds are due except where the law requires. We may terminate for material breach uncured after notice, or for non-payment. After closure, we make your data available for export for 30 days, then delete or anonymise it, subject to legal retention duties.

8. Availability and support

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance is announced in advance where possible. Support is provided in French, Arabic, and English during Moroccan business hours.

9. Intellectual property

The Tamobila software, brand, and documentation remain our property. Feedback you send us may be used to improve the product without obligation.

10. Liability

To the fullest extent permitted by law, Tamobila's aggregate liability for claims arising out of the service in any 12-month period is capped at the amounts you paid us for the service during that period. We are not liable for indirect damages (lost profits, lost data not caused by our breach, business interruption), nor for disputes between you and your customers — rental contracts are concluded between you and them. Nothing limits liability that cannot legally be limited.

11. Changes to these terms

We may update these terms; material changes are notified in the application or by email at least 30 days before they take effect. Continuing to use the service after that date constitutes acceptance.

12. Governing law and jurisdiction

These terms are governed by Moroccan law. Disputes that cannot be resolved amicably fall under the exclusive jurisdiction of the competent courts of Agadir, Morocco.
